Terms of Use

1. Acceptance of these terms

By accessing or using our websites, applications, APIs, or related services (together, the “Service”), you agree to these Terms and acknowledge our Privacy Policy. If you use the Service for an organization, you represent that you are authorized to accept these Terms for it. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 13 years old to create an account or submit personal information. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. The Service is not directed to children under 13.

3. The Service

Sabantuy Club helps people discover, document, and support Sabantuy celebrations and related community activity. We may add, change, suspend, or discontinue features. The Service is currently community-focused, but it is operated by a for-profit company and may include paid products, sponsorships, advertising, or other commercial features in the future. We will disclose applicable prices and additional terms before you make a purchase.

4. Accounts

Account features are not yet available. When they are introduced, you may be able to sign in through Google, Apple, Facebook, or another provider. You are responsible for activity under your account and for keeping access to your sign-in provider secure. Provide accurate information, do not impersonate anyone, and notify us promptly if you believe your account has been compromised.

5. Event and community information

Event listings may come from organizers, community members, or publicly available sources. We work to preserve sources and verification history, but we do not guarantee that any listing is complete, current, accurate, safe, accessible, or suitable for you. Dates, locations, prices, entry rules, and cancellations can change. Confirm important details directly with the organizer before traveling, paying, or attending.

Organizers are independent from Sabantuy Club unless we expressly say otherwise. A listing is not an endorsement, and we are not a party to arrangements between you and an organizer, venue, vendor, or attendee.

6. Your submissions

You keep ownership of content you submit. You give us a worldwide, non-exclusive, royalty-free license to host, copy, adapt, translate, display, and distribute that content only as reasonably necessary to operate, improve, and promote the Service. This license ends when the content is deleted from our systems, except for copies we must retain for legal, security, backup, or integrity purposes.

You represent that you have the rights and permissions needed for your submission and that it does not violate law or another person’s rights. Community introductions are private communications to our team and are not published under this license unless we separately ask for permission.

7. Acceptable use

You may not:

• break the law or infringe intellectual property, privacy, or other rights;
• harass, threaten, deceive, discriminate against, or exploit another person;
• submit malware, spam, false listings, or unauthorized promotional material;
• bypass security or access controls, probe for vulnerabilities, or disrupt the Service;
• scrape or use automated means in a way that burdens the Service or violates law;
• use Service data to build profiles of people or identify a private location; or
• misrepresent your relationship with Sabantuy Club or its community.

8. Donations and payments

Donations are voluntary and support the Service’s operation. Unless we expressly state otherwise, donations are not tax-deductible, do not represent an investment, and do not give you ownership, voting rights, or guaranteed benefits. Stripe or PayPal may process payments under their own terms. Donations are generally final, except where the law requires a refund or we agree otherwise. You may cancel a recurring donation through the applicable payment provider or by contacting us.

9. Our content and trademarks

The Service, including its design, software, original text, branding, and compiled data, belongs to SW Gaming LLC or its licensors and is protected by law. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service. They do not transfer ownership of any intellectual property. “Sabantuy Club” and associated branding may not be used in a way that implies endorsement without written permission.

10. Third-party services

The Service links to third-party sites and may integrate third-party sign-in, analytics, hosting, payment, mapping, or social-media services. Their services and content are governed by their own terms and privacy practices. We are not responsible for third-party services we do not control.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded. You remain responsible for your personal safety and decisions at events.

12. Limitation of liability

To the fullest extent permitted by law, SW Gaming LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Service or an event. Our total liability for all claims relating to the Service will not exceed the greater of $100 or the amount you paid us, excluding donations, in the 12 months before the event giving rise to the claim.

These limits apply only where permitted by law and do not limit liability that cannot legally be limited.

13. Suspension and termination

You may stop using the Service at any time. We may restrict or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, or interfered with the Service or community. Where practical, we will provide notice and an opportunity to appeal by email. Provisions that by their nature should survive termination will survive.

14. Changes to these Terms

We may update these Terms as the Service and law change. We will post the revised version and update its effective date. If a change materially affects your rights, we will provide additional notice when reasonably possible. Continued use after the new Terms take effect means you accept them.

15. Governing law and general terms

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. If a provision is unenforceable, it will be limited to the minimum extent needed and the remaining provisions will stay effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, sale, or by operation of law. These Terms and any feature-specific terms form the entire agreement about the Service.
